Information clause on sponsorship of participation in an event

As We are sponsoring your participation in the event we are obliged under the GDPR and the Data Protection Act to provide you with the following information:

 

  • The Controller of your personal data is Us, i.e. Zakłady Farmaceutyczne “Polpharma” Spółka Akcyjna with registered office: 83-200 Starogard Gdański, ul. Pelplińska 19, registered in the register of entrepreneurs of the National Court Register under KRS no.: 0000127044, with share capital of PLN 100,207,830.00 (paid in full), NIP no. 5920202822, REGON 190929369.
  • We process your personal data for the following purposes:
    1. performance of the contract
    2. to make tax settlements and keep accounting records – in connection with our obligations under tax law and accounting regulations
    3. the defence, establishment or assertion of possible claims between us and you – based on our legitimate interest
    4. the creation of anonymised statistical data for the Transparency Report – based on our legitimate interest
  • You have the right to:
    1. access to their personal data,
    2. requests for rectification
    3. request their removal,
    4. request to restrict or object to their processing,
    5. portability of personal data – i.e. to receive the personal data you have provided to us in a structured, commonly used, machine-readable format.
  • You may request that we forward your personal data to another controller.
  • To exercise your rights, you may contact the controller or the Data Protection Officer.
  • You have the right to complain to the competent authority (the President of the Data Protection Authority) about our processing of your personal data which does not comply with the GDPR.
  • You provide your personal data voluntarily, but it is necessary for us to conclude and perform the contract.
  • We may disclose your personal data to other entities, in particular:
    1. our employees and associates
    2. to courier and postal services providers
    3. service providers: IT, consulting, insurance, legal, financial
    4. entrusted for processing for the preparation and publication of the Transparency Report
    5. to those who are entitled to receive them by law
  • We will process your personal data
    1. until the purposes of the processing have been achieved, or
    2. until an objection is lodged, whichever comes first.
  • We will then store your data
    1. until the statute of limitations for the claim or
    2. until the expiry of our legal obligations
    3. depending on what comes next.

  • The companies of the ZF Polpharma group apply the code of the organisation Medicines for Europe. Accordingly, we are obliged to prepare and publish a Transparency Report. For this purpose, We may entrust the processing of your personal data. The personal data that will be included in the report will be anonymised and aggregated to statistical data.
  • We will publish the Transparency Report on publicly accessible websites:
    1. polpharma.pl,
    2. producencilekow.pl.
  • We will publish a transparency report by 30 June of the year following the year in which the event took place.
  • We will process anonymised statistical data as part of the Transparency Report for a period of 3 years after publication. After this period, We will process your data until the statute of limitations for claims.

  • The Controller of the personal data processed for the purposes of performance and implementation of the Agreement is Zakłady Farmaceutyczne POLPHARMA S.A. with its registered office: 83-200 Starogard Gdański, Pelplińska 19 St., registered in the register of entrepreneurs in the District Court Gdańsk Północ in Gdańsk, VII Commercial Division of the National Court Register under the number 0000127044.
    The Controller can be contacted by means of correspondence data or by telephone at tel. no. +48 58 563 16 00.
  • The Controller has appointed a Data Protection Officer for the due protection of personal data, who can be contacted at the e-mail address: iod@polpharma.com. For all matters concerning the processing of personal data and the exercise of your rights in relation to the processing of personal data, you may contact the Data Protection Officer.
  • The Controller processes the data of natural persons for the purpose of signing and performing a contract. The data of persons who are natural persons conducting business activity or, in the case of a partner of a civil partnership who is a party to the contract, shall be processed for the purpose of concluding and performing the contract on the basis of which the cooperation is based. The legal basis for the processing of the data of persons whose data are processed for the purpose of concluding and performing the Contract (employees and co-workers, persons authorised to represent the Contracting Party) is the legitimate interest of the Controller – contact regarding the performance of the Contract. In connection with the performance of the Agreement, the data of the aforementioned persons may be processed for the possible assertion or repudiation of claims arising from the Agreement and in connection with the fulfilment of legal obligations imposed on the Controller, in particular tax law, financial reporting in connection with the performance of the Agreement. Personal data may also be processed in connection with the conduct of internal activities related to the activities of the controller, including audits. The provision of personal data is voluntary, but necessary in order to sign the Agreement. Personal data are not subject to automated processing including profiling.
  • If the Controller did not obtain the data directly from you, your personal data in the following areas: identification data (name and surname), contact data (e-mail address), other data (place of employment) may have been obtained by the Controller from the contract on the basis of which the Controller processes your data or made available by your employer.
  • Personal data will be processed for the duration of the contract. The personal data contained
    in the contract will also be processed for the period resulting from the applicable legal provisions, including tax and accounting regulations. Personal data may,
    in certain cases and to an adequate extent, be
    retained and processed by the Controller to secure possible claims until they become time-barred, for the period required by law.
  • Recipients of personal data may be entities processing personal data on behalf of the Controller, i.e. external entities providing and supporting IT systems used for the purposes of the execution of this agreement, as well as other entities providing services related to the current activity of the Controller and only under relevant personal data processing entrustment agreements and with the assurance of the application by the aforementioned entities of adequate technical and organisational measures ensuring data protection. Personal data may also be made available to entities authorised on the basis of applicable laws. As a rule, personal data will not be transferred to a third country or international organisation outside the European Economic Area. In some situations, due to the Controller’s cooperation
    with service providers for the purposes of personal data processing, personal data may be transferred to countries outside the European Economic Area, however, in this case the Controller will take care of all formalities related to the proper protection of personal data, including, among others, the use of standard contractual clauses adopted by the European
    Commission.
  • Each person whose data is processed, to the extent required by law, has the right of access to his or her data and the right to rectification, erasure, restriction of processing and the right to object to the processing, and the right to data portability.
  • In case of doubts related to the processing of personal data, any person may request information from the Controller. Notwithstanding the above, anyone has the right to lodge a complaint with the supervisory authority – the President of the Office for Personal Data Protection.
